What to expect during the preparation of an affidavit or statutory declaration
Saturday, August 22, 2015
Affidavits and statutory declarations are written statements that are used for the purpose of establishing legal rights, e.g. to be used as evidence in court. It is therefore very important that these documents are properly made, so that the legal rights are not impaired or destroyed.

Service Description
Administering Oaths and Affirmations
Oaths and affirmations are both solemn promises of truthfulness made by either a signer, a witness, or a new office-holder. An oath is a promise to a deity and an affirmation is a pledge on one's personal honour. Both are legally binding promises to tell the truth and subject the oath-taker or affirmant to penalties for perjury. The Commissioner of Oaths acts thereby as a witness, certifying the oath or affirmation with his signature or with a jurat clause for a signed document.
An affidavit is a declaration or statement of facts, confirmed by the oath of the party making the affidavit. It is taken before the Commissioner of Oaths, who is a person having authority to administer such an oath. Examples for affidavits are Affidavits to Transfer Ownership of Vehicles, Affidavits for Professional Accreditation, Affidavits for Insurance Claims. Please note, current proper identification (picture ID) is necessary and the individual(s) requiring the service must be present.
If you need to produce an official copy of a document for your proceedings, you may need to make a sworn declaration before a commissioner for oaths and sign the document in the commissioner?s presence. This formality gives the document official status. Examples for statutory declarations are Statutory Declarations Confirming Identity, Statutory Declaration of Marital Status or Common-Law union, Statutory Declaration in regards Ownership of Property. Other declarations may be Wills, Letters of Consent, Invitation Letters, Immigration Documents and more.
Damaged, Destroyed and Lost Passport Statutory Declarations
Passport Canada concisely outlines the steps you must go through to replace a stolen, damaged, lost or destroyed passport. In addition to reporting a lost or stolen passport, you will need a statutory declaration when applying for a new passport. Please refer to Passport Canada for exact requirements.

Governments and organizations sometimes require that documents be authenticated before they will accept them. The Commissioner of Oaths will take care of certifying, signing and sealing your document. Documents may contain attachments such as exhibits or schedules.
An affidavit may require reswearing, reaffirming or redeclaring, if the previous work was administered incorrectly. Any affidavit can be resworn as long as it has not been used.
Please Note
The Commissioner of Oaths does not certify the truth of the statements contained in any document; rather this responsibility remains with the declarants and deponents.
